TERMS OF USE

The website located at www.mobilub.com (“Site”) is owned and operated by Mobilub Holdings Sdn. Bhd. (“Mobilub”, “Company”, “we”, “us”, or “our”).

By accessing the Site, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are acting on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms and Conditions.

PRICE AND PAYMENT

Where applicable, all prices displayed on the Site are in Malaysian Ringgit (RM).

Delivery charges, where applicable, will be displayed separately and included in the final amount payable before checkout.

You may purchase products by following the ordering procedures provided on the Site and make payment through our approved payment partners.

Once an order has been confirmed and payment has been successfully processed, amendments or cancellations may not be possible. However, Mobilub may, at its sole discretion and subject to operational feasibility, assist with amendment requests submitted before the order has been dispatched.

Mobilub shall not be responsible or liable for any products purchased through channels other than the Site.

Free gifts may be substituted with items of similar value subject to stock availability and without prior notice.

All free gifts are non-refundable, non-exchangeable, subject to availability, and available on a first-come, first-served basis.

ORDER OR PRODUCT COMPLAINTS

In the event of packing errors, including missing products or wrongly packed orders, customers are encouraged to notify our Support Team within five (5) calendar days from the date of delivery as reflected by the courier’s tracking records.

In the event of damaged or defective products, customers are encouraged to notify our Support Team within five (5) calendar days from the date of delivery and provide supporting photographs and proof of purchase.

Mobilub will review and verify all claims and, where appropriate, provide remedial action, including replacement, refund, or other suitable resolution.

Failure to notify Mobilub within the above period may affect the processing of the claim, without prejudice to any rights available to consumers under applicable Malaysian law.

RETURN AND REFUND POLICY

All goods sold are non-returnable and non-refundable except where:

• the product is defective;
• the product is damaged during delivery;
• the wrong product was supplied; or
• a refund, replacement, or other remedy is required under applicable Malaysian law.

Refunds will only be processed after the returned product has been received and inspected by Mobilub.

Returned products must be in their original condition and packaging, unless the return is due to defects, damage, or incorrect fulfilment.

Refunds, where approved, will be made via bank transfer or such other payment method as determined by Mobilub.

Mobilub reserves the right to reject returns or refunds where products have been used, altered, damaged by the customer, or returned incomplete, unless otherwise required under applicable law.

PROCESSING YOUR ORDER

Orders are generally processed within four (4) to seven (7) working days.

Delivery timelines are estimates only and may vary depending on stock availability, courier operations, public holidays, weather conditions, or circumstances beyond our reasonable control.

Mobilub shall not be liable for delays caused by courier services or events beyond its reasonable control, except where liability cannot be excluded under applicable law.

Self-collection from our warehouse is not available.

If delivery cannot be completed due to incorrect or incomplete information provided by the customer, or where delivery attempts are unsuccessful, the parcel may be returned to Mobilub.

Where appropriate, refunds for returned parcels or out-of-stock products will be made via bank transfer or such other payment method determined by Mobilub.

DELIVERY FEES

For Orders between RM0.01 and RM149.99:
Shipping Fee: RM8.00 (Flat Rate)

For Orders of RM150.00 and above:
Free Delivery, subject to applicable promotional campaigns.

Delivery availability is subject to locations serviced by our courier partners.

Mobilub reserves the right to revise delivery charges and courier partners from time to time. Any revised charges shall apply only to orders placed after such revisions are published on the Site.

PROMOTIONS

Promotional offers may vary between new and existing customers.

Unless otherwise specified, promotions are applicable only to purchases made under a single receipt and cannot be combined with other promotions.

Mobilub reserves the right to amend, suspend, terminate, or vary any promotion, marketing activity, or campaign at any time. Such changes shall not affect orders that have already been confirmed and paid for unless fraud, abuse, or manifest error is involved.

ACCOUNTS

You represent and warrant that all information provided during account registration is accurate, complete, and up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

You must immediately notify Mobilub of any unauthorized use or suspected security breach.

Mobilub shall not be liable for unauthorized access resulting from your failure to safeguard your login credentials, except where such unauthorized access results from Mobilub’s negligence, security breach, or failure to implement reasonable security measures.

PROMOTIONAL EMAILS

By creating an account, you may opt to receive newsletters and marketing communications from Mobilub.

You may unsubscribe from marketing communications at any time through the unsubscribe link provided in the communication or by contacting us directly.

PERSONAL DATA PROTECTION ACT (PDPA)

By creating an account or using the Site, you consent to Mobilub collecting, using, processing, storing, and disclosing your personal data for the following purposes:

• processing and fulfilling orders;
• managing your account and providing customer support;
• communicating with you regarding products, services, and transactions;
• complying with legal and regulatory obligations; and

Mobilub may disclose your personal data to:

• courier and logistics service providers;

Product images are for illustration purposes only.

Mobil reserves the right to amend or change product packaging, labels, and non-material product presentation from time to time without prior notice, provided that such changes do not materially affect the product’s specifications, quality, or intended use.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Mobilub shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business interruption, loss of data, or loss of goodwill arising from the use of the Site or the purchase of products.

Nothing in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable Malaysian law.

FORCE MAJEURE

Mobilub shall not be liable for any delay or failure to perform its obligations arising from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, governmental actions, strikes, cyber incidents, transportation disruptions, or failures of third-party service providers.

GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.

The parties submit to the exclusive jurisdiction of the courts of Malaysia in relation to any dispute arising out of or in connection with these Terms and Conditions.

AMENDMENTS

Mobilub reserves the right to amend these Terms and Conditions from time to time.

Any amendments shall take effect upon publication on the Site and shall apply prospectively. Continued use of the Site after such publication constitutes acceptance of the revised Terms and Conditions.
